1. Purpose
These General Terms and Conditions of Sale (GTCS) define the rights and obligations of the artisan-creator (hereinafter referred to as "the Seller") and any person making a purchase via the website (hereinafter referred to as "the Customer"). They apply to all sales of original creations made by hand and, where applicable, to custom orders.
2. Products
The products offered are handcrafted, handmade in small series or on request. Due to this unique character, slight variations in color, shape or size may exist between the models presented online and the items delivered. These differences do not constitute a lack of conformity, nor are they grounds for cancelling an order.
3. Controls
Any order placed on the site implies acceptance of these GTC and a firm commitment by the Customer.
For personalized creations, a specific lead time will be communicated before final validation of the order. Custom orders cannot be cancelled or reimbursed in accordance with article L221-28 of the French Consumer Code.
4. Awards
Prices shown on the site are in euros, inclusive of all taxes, and exclude delivery charges. The Vendor reserves the right to modify its prices at any time; however, products will be invoiced on the basis of the rates in force at the time the order is placed.
5. Terms of payment
Payment is due immediately at the time of order and is made using the secure payment methods offered on the site. No delivery will be made until payment has been received.
6. Delivery
- Packages are dispatched from France to the address indicated by the Customer at the time of ordering.
- Each shipment is made with a tracking number communicated to the Customer by email.
- Delivery times are indicative and may vary according to destination and time of year.
- If delivery is not possible in the country of destination, the Customer is invited to contact the Vendor in advance in order to agree on a solution.
- Transport risks are transferred to the customer as soon as the package is handed over to the carrier.
7. Right of withdrawal and returns
In accordance with articles L221-18 et seq. of the French Consumer Code, the customer has a statutory period of 14 clear days from receipt of the standard product (excluding personalized or custom-made creations) to exercise his right of withdrawal.
- Prior to any return, the Customer must contact the Seller by email in order to inform us of your decision to cancel and to obtain return instructions.
- The product must be returned in perfect condition, complete, unused and in its original packaging.
- Visit return postage are the exclusive responsibility of the Customer.
- All returns must be sent using a tracking method to ensure that the Vendor receives the package correctly.
- After verification of the conformity of the return, the price of the product (excluding initial delivery costs) will be reimbursed within a maximum of 14 days from receipt of the parcel by the Vendor, using the same means of payment as that used to place the order.
Our creations made-to-order or customized are excluded from the right of withdrawal and cannot be returned or reimbursed under any circumstances (article L221-28 of the French Consumer Code).
8. Legal warranties
The Vendor is liable for defects in conformity of the goods (articles L217-4 to L217-14 of the French Consumer Code) and for hidden defects (articles 1641 to 1648 of the French Civil Code). In the event of a defect, the customer is entitled to repair, replacement or reimbursement in accordance with legal provisions.
9. Liability
The Vendor cannot be held responsible for delays in delivery attributable to the carrier, nor for damage caused by misuse of the products by the Customer.
10. Data protection
Personal data collected at the time of ordering is used solely for processing purchases and managing customer relations, in accordance with the General Data Protection Regulation (RGPD). Under no circumstances will it be passed on to unauthorized third parties.
11. Intellectual property
All models, photographs and texts on the site remain the exclusive property of the Seller and may not be used without prior authorization.
12. Disputes
These terms and conditions are governed by French law. In the event of a dispute, an amicable solution will be sought as a matter of priority. Failing amicable settlement, the competent French courts will have sole jurisdiction.
